Got 5 Terms of Service

Please read this agreement before registering for the Got 5 program.

Please read this agreement carefully before registering. By checking the box below and submitting your registration, you agree to be bound by these terms. If you do not agree, do not register.

1. About Got 5 and Fire Adapted Park County

Got 5 is a community preparedness program operated by Fire Adapted Park County (“FAPC”), a Colorado nonprofit organization. Got 5 provides an information-sharing platform that connects community members who wish to offer neighbor-to-neighbor assistance (“Volunteers”) with community members who are seeking such assistance (“Recipients”) in the event of a wildfire, evacuation, or other emergency.

FAPC is a facilitator only. It operates a contact directory and an automated matching service. It does not provide emergency services, dispatch personnel, coordinate emergency response, supervise volunteers, or guarantee that any assistance will be available or provided.

2. Got 5 Is Not an Emergency Service

Got 5 is not an emergency response service and must not be treated as one.

  • Got 5 is not monitored in real time.
  • Got 5 is not a substitute for calling 911 or contacting professional emergency services.
  • Volunteers connected through Got 5 are private individuals. They are not on call, are not dispatched by FAPC, and are not obligated to respond during any emergency.
  • In any life-threatening emergency, you must contact 911 or your local emergency management agency immediately. Do not rely on Got 5 as your primary or sole means of emergency assistance.

3. FAPC’s Role Is Limited to Making Introductions

FAPC’s sole function is to share contact information between matched Volunteers and Recipients based on self-reported location and assistance categories. Once a match is made and contact information is shared:

  • All further communication is between the Volunteer and Recipient directly.
  • FAPC has no involvement in, knowledge of, or responsibility for any interactions, agreements, or actions between Volunteers and Recipients.
  • FAPC does not supervise, direct, instruct, or coordinate Volunteers at any time, including during an emergency.

4. No Vetting, Screening, or Certification of Volunteers

FAPC does not screen, background check, verify, certify, train, or evaluate Volunteers in any way. All information provided by Volunteers — including their name, contact information, location, and the types of assistance they offer — is entirely self-reported and has not been verified by FAPC.

The assistance categories available in Got 5 (such as Transportation, Pet/Animal Evacuation, or Mobility Assistance) describe only what a Volunteer has chosen to offer. They do not represent any finding by FAPC that a Volunteer is qualified, experienced, or capable of providing that assistance in any particular situation.

Recipients are solely responsible for independently assessing whether a matched Volunteer is suitable for their specific needs before relying on them for any purpose.

5. No Guarantee of Assistance

Registration with Got 5 does not guarantee that:

  • A matched Volunteer will be available when needed
  • A matched Volunteer will respond to contact attempts
  • A matched Volunteer will be able to provide assistance during an actual emergency
  • Any assistance provided will be adequate, timely, or appropriate for the Recipient’s needs

Recipients must maintain their own emergency plans and must not rely solely on a Got 5 connection as their only means of preparedness, evacuation planning, or emergency assistance.

6. Volunteers Are Independent Individuals, Not Agents of FAPC

Volunteers who register with Got 5 are private individuals acting entirely on their own behalf. They are not employees, contractors, agents, representatives, or volunteers of FAPC in any legal sense. FAPC is not responsible for the conduct, actions, omissions, or decisions of any Volunteer before, during, or after an emergency.

Any assistance a Volunteer provides is given voluntarily, at their own discretion, and entirely outside the control or supervision of FAPC.

7. Assumption of Risk

By registering with Got 5, you acknowledge and agree that:

  • Participation in the Got 5 program involves inherent risks, including but not limited to physical injury, property damage, or death, arising from emergency situations, evacuation activities, or interactions with other participants.
  • Meeting or interacting with other participants — whether known or unknown to you — carries risks that FAPC cannot foresee, prevent, or control.
  • You are voluntarily assuming all risks associated with your participation in the Got 5 program and with any actions you take or fail to take in connection with it.
  • Your safety and the safety of those in your care is your sole responsibility at all times.

8. Your Personal Safety Comes First

Both Volunteers and Recipients are reminded that their own safety — and the safety of those in their care — must always take priority over any commitment made through Got 5.

Volunteers are not obligated to put themselves in danger to fulfill a Got 5 connection. If providing assistance would place you, your family, or your property at unreasonable risk, you should prioritize your own safety and evacuation.

Recipients should not wait for a Got 5 Volunteer if doing so would place them in greater danger. Follow all official evacuation orders and instructions from emergency management authorities immediately.

9. Limitation of Liability

To the maximum extent permitted by Colorado law, Fire Adapted Park County, its board members, officers, employees, and volunteers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Your participation in the Got 5 program
  • Any actions or omissions of any Volunteer or Recipient
  • Any failure of a Volunteer to respond, appear, or provide assistance
  • Any harm caused by a Volunteer during the provision of assistance
  • Any inaccuracy in self-reported information provided by any participant
  • Any failure of the Got 5 platform to function as expected

This limitation applies regardless of the theory of liability and even if FAPC has been advised of the possibility of such damages. In no event shall FAPC’s total liability to you exceed one dollar ($1.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Fire Adapted Park County, its board members, officers, and staff from and against any claims, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your participation in the Got 5 program
  • Any assistance you provide or receive through Got 5
  • Your violation of these Terms
  • Any harm caused by your actions or omissions in connection with the program

11. No Professional Services

Nothing in the Got 5 program constitutes or should be construed as professional medical, legal, mental health, emergency management, or other licensed professional advice or service. Got 5 does not provide and is not responsible for any professional services of any kind.

12. Accuracy of Information

By registering, you represent that all information you provide is accurate, current, and complete. You agree to promptly update your information if it changes. You understand that providing false or misleading information may result in removal from the program.

13. Program Participation Is Voluntary and May Be Withdrawn

Participation in Got 5 is entirely voluntary. FAPC reserves the right to remove any participant from the program at any time, for any reason, without notice. Participants may remove themselves from the program at any time using the profile management link provided in their registration email.

14. No Waiver of Emergency Services

Nothing in this Agreement should be interpreted as discouraging or preventing you from contacting 911 or other professional emergency services. In any emergency, contact professional emergency services first.

15. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Colorado. Any dispute arising out of or related to this Agreement or your participation in Got 5 shall be resolved in the state or federal courts located in Park County, Colorado, and you consent to the personal jurisdiction of those courts.

16. Changes to This Agreement

FAPC reserves the right to update these Terms at any time. Continued participation in the Got 5 program following notice of changes constitutes acceptance of the revised Terms.
